OPTIMUM REFER A FRIEND PROMOTION

OVERVIEW (NOT PART OF CONDITIONS)
Principal entry requirement: An OPTIMUM Member aged 13 years or older, who, during the Entry Period, confirms or updates their membership details at www.optimumpet.com.au will be allocated one entry into the draw.
That OPTIMUM Member may then invite up to five friends aged at least 13 years of age to also become OPTIMUM Members. For every invited friend who becomes an OPTIMUM Member during the Entry Period the inviting OPTIMUM Member will (subject to a a “first in best dressed” and other provisions) be allocated an additional entry into the draw.
Entry Period: opens at 10am on 16/4/08 and ends at 10am on 14/5/08.
Entry method: by internet.
Prize Pool: 50 x $100 Wishlist Voucher
Prize Pool Value: The total value of all prizes is $5,000.
Prize distribution: The draw will be held at 178 Albert Street, Windsor VIC 3181 and will commence at 11am on 16/5/08.
 
CONDITIONS
PARTICIPATION
1.    This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Petcare Australia, of Petcare Place, Wodonga VIC 3690 (“Promoter”).
2.    Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3.    The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is an OPTIMUM PHD Member (“Member”); and (ii) is a resident of Australia aged 13 years or older as at the time of entry; and (iii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.
4.    Competition entry opens at 10am on 16/4/08 and closes at 10am on 14/5/08 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.
ENTRY
5.    To enter, an Eligible Entrant must, during the Entry Period, use a compatible browser to visit www.optimumpet.com.au (the "Optimum Website") and follow the directions there to: (i) review his/her Member details, and (ii) either confirm, or update, those details (“Update Their Membership”).
6.    Subject to the other conditions, an Eligible Entrant who Updates Their Membership (whether once, or more than once) will be awarded ONE entry into the Competition.
7.    An Eligible Entrant who Updates Their Membership will then have the opportunity to invite up to five friends who must be aged at least 13 years of age at the time of referral to become a Member. The Optimum Website will generate and send an e-mail from the referring Member to each referred friend, inviting each friend to become a Member. For each referred friend who subsequently becomes a Member during the Entry Period, the referring Member (if eligible to enter the Competition) will automatically be awarded one additional entry into the Competition, subject to the following provisions:
(i)    To determine whether a new Member is another Member's referred friend (entitling the referring Member to an additional entry), the Promoter will match the e-mail address given by each new Member with the e-mail addresses to which e-mails were sent inviting referred friends to become Members.
(ii)    If the same person is referred as a friend of more than one Member, only one additional entry will be made and it will be allocated to the Member who first referred that person.
(iii)    If a referred friend is already a Member, no entry will be awarded.
(iv)    A Member cannot refer a friend who has already been invited directly by the Promoter to become a Member.
8.    All entrants must ensure that they confirm or update their Member details, and refer any friends, during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
9.    All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
10.    The Promoter may, at its absolute discretion, declare any or all entries awarded to an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 9 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering.
INTERNET ENTRIES
11.    Any costs associated with accessing the Optimum Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
12.    Eligible Entrants must confirm or update their Member details, and refer any friends, manually using an internet browser. The Promoter may elect not to award entries if it reasonably forms the opinion that data has been entered using automated data entry means, or by use of a competition entry service.
DRAW AND PRIZE
13.    The draw will be held at 11am on 16/5/08 at 178 Albert Street, Windsor VIC 3181.
14.    The Eligible Entrants whose valid entries are the first 50 valid entries drawn, will each win one $100 Wishlist Voucher (“Wishlist Voucher”) (further details of this prize are set out below).
15.    The total value of all prizes is $5,000.
16.    If a prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize is unavailable for any reason.
17.    A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment
18.    If the winner of a prize is under 18 years of age, the prize will be awarded to a parent or guardian of the winner, as determined by the Promoter, on the winner's behalf.
WISHLIST VOUCHER
19.    Each Wishlist Voucher:
(i)    is issued by Wishlist Holdings Ltd, ABN 38 085 529 979 (“Wishlist Holdings”);
(ii)    is issued subject to such conditions as may be imposed by Wishlist Holdings from time to time. (The full conditions to which the Wishlist Voucher is subject, are available at www.wishlist.com.au);
(iii)    may only be used for online purchases at www.wishlist.com.au.
(iv)    is not transferable;
(v)    is not redeemable for cash;
(vi)    cannot be used to purchase other gift cards or vouchers;
WINNERS
20.    Each winner will be notified in writing sent by e-mail to the e-mail address in their Member record. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
21.    Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner within 3 months of the draw, the prize will be awarded to another Eligible Entrant in a redraw commencing at 11am on 1/9/08 at 178 Albert Street, Windsor VIC 3181.
22.    In order to be entitled to their prize, a winner must, if requested by the Promoter, agree to and sign an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize. A winner who does not comply with this condition forfeits their prize.
GENERAL
23.    If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
24.    The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; and (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
25.    CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
26.    All of the Promoter’s decisions are final and no correspondence will be entered into.
27.    The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
28.    To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
29.    Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s). The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1, by calling number 1800 640 111 during business hours or by visiting www.optimumpet.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
